Introduction

In the fiscal year 2023-24, Non-Government employees in India face a crucial decision – whether to embrace the new income tax regime or stick to the familiar old one. Therefore, This article aims to simplify this decision-making process and shed light on the nuances that individuals need to consider.

Evolution of Tax Regimes

The introduction of Section 115BAC in the Income Tax Act of 1961 in April 2020 marked a pivotal moment. In other words, It presented individuals and Hindu Undivided Families (HUFs) with the choice of opting for reduced tax rates by forgoing certain deductions and exemptions. Fast forward to 2023, and the landscape has evolved, making the new tax regime the default option as per amendments in the Union Budget.

Key Changes in the New Tax Regime

  1. Higher Basic Exemption Limit: However, The basic exemption limit under the new tax regime has risen to INR 3 lakh from the previous INR 2.5 lakh.
  2. Tax Rebate: Income up to INR 7 lakh is now eligible for a tax rebate, up from INR 5 lakh, according to section 87A.

Comparing Deductions and Exemptions

Under the old tax regime, various deductions for allowances and specified investments are available. However, the new regime offers a standard deduction and full rebate for individuals earning up to INR 7 lakh annually. Those surpassing this income need to weigh the options carefully, as the old regime provides deductions and exempts income up to INR 5 lakh.

Choosing Your Tax Regime

For the fiscal year 2023-24, individual taxpayers must decide between the old and new tax regimes while filing their income tax returns. Let's delve into the features of the new tax regime to aid in this decision-making process.

Features of the New Tax Regime

The new tax regime introduces seven tax slab rates, ranging from 0% to 30%. In contrast, the old regime has five tax slab rates, with the lowest starting at INR 3 lakh. For those under the old system, income up to INR 2.5 lakh is exempt from personal income tax.

Forfeiting Deductions and Exemptions

To streamline the tax structure, the new tax regime necessitates forgoing specific deductions and exemptions. Some exclusions include leave travel allowance (LTA), house rent allowance (HRA), and various other deductions under Section 80C.

Making Your Choice

The decision between the old and new tax regimes hinges on your unique financial situation. Taxpayers with investments in tax-saving instruments and those benefiting from deductions like HRA may find the old tax regime advantageous. The absence of a one-size-fits-all answer emphasizes the need for a careful evaluation of your tax liability under both regimes.

How to Opt for the Old Tax Regime in 2023

As of now, taxpayers with income from a business or profession need to file Form 10IE to opt for the new tax regime. However, proposed amendments suggest that actively choosing the old tax regime for FY 2023-24 will be necessary. The specifics of this process will be determined by the tax department.

Conclusion

In conclusion, the income tax landscape in India is undergoing significant changes, with the new tax regime taking centre stage. While aimed at simplifying the tax structure and reducing the burden on taxpayers, the choice between the old and new tax regimes remains highly individual. Each taxpayer must assess their unique financial circumstances before making an informed decision.

What is Income Tax Form 16?

Form 16 is a document or certificate issued under Section 203 – Income-Tax Act 1961 to salaried employees in India by their employers. Also called a "wage certificate", it contains all the information about the wages paid to the employee by the organization or employer in a particular fiscal year and the income taxes deducted by the payer from the person's wages.

Under the Income Tax Act, at the time of payment of salary, every employer is required to withhold tax (or TDS - income tax), which is calculated based on the income tax rates in force for that financial year. Companies usually calculate an employee’s tax liability based on the employee’s expected income and the amount invested at the beginning or during the year.

The TDS so withheld by the organization or employer is filed with the Income Tax Department and Form 16 in turn is the proof thereof. Employers must submit Form 16 to their employees on or before May 31 of the financial year immediately following the financial year in which the tax was paid and tax withheld.

Form 16 It contains all the information about the wages received by the employee, including the tax deducted from the wages.

Form 16 is divided into the following two-part, inter alia:

Form 16 Part A

Part A actually lists the tax collected by the organization or employer on wage income, on behalf of the employee and deposited into the government account. It is a document duly signed by the employer that TDS has been withheld from the salary of the employee and remitted to the Income Tax Department.

(TAN refers to the amount allocated to the account liable to deduction and tax). This data helps the IT department track the flow of money from employee and employer accounts. (It should be noted that if an organization does not have a TAN, it is not entitled to a TDS exemption. So in this situation Form 16 will not be issued)

• Assessment Year (A.Y) – As the name suggests, this refers to the year in which the income is received or in other words, the year in which the taxpayer is required to deal with tax filing transactions. For example, for income earned between April 1, 2015, and March 31, 2016, the assessment year is 2016-17.

• The period during which the person was employed by the employer in the relevant Financial Year

• Summary of wages paid

• Date of withdrawal from pay

• Tax payment date on government account

• Quarterly tax summary attached and filed with the Income Tax Department

• TDS payment confirmation number

How does Form 16 matter to a salaried employee?

For a salaried employee, Form 16 is important from an income tax point of view. The information stated on this form is required to file an income tax return.

With this document, a taxpayer can easily prepare his own income tax return in India, without the help of chartered accountants or financial planners. This applies mostly to people, whose only source of income is the salary they receive from their organisation.

Form 16 can be used to ascertain whether the correct tax has been deposited with the government. account by comparing the amounts against Form 26AS.

It is also not only a proof of TDS but is also considered an important document for tax compliance. It is the only document an employee has to provide to prove that he or she has paid tax and can be shown as evidence during any income tax assessment. Banks, other lenders, and financial institutions also accept it as valid proof of income. For credit applications, many financial institutions require this document as part of their verification process.

Download and Prepare at a time 50 Employees Form 16 Part A&B for the F.Y.2022-23

Most organizations require a Form 16 from a previous employer (during the same financial year) to be presented to them as part of their induction process. This helps them streamline the tax calculation since income tax brackets change based on an individual’s total income for the year.

Also, if one is planning to emigrate, many visa lists, such as the one for a Scheme visa, call for Form 16 as one of the documents to be submitted.

Multiple employers in a fiscal year

Individuals who have changed employment and therefore worked for more than one employer in a given financial year obtain a Form 16 from all employers individually.

Employer's liability w.r.t. Form 16

The Employer or Collector should ensure that all the details mentioned in Form 16, such as salary, deductions, PAN, TAN, etc., are duly recorded and that each page is signed by a competent person with the responsibility of the Company. The certificate must also be submitted on or before the 31st deadline

It can be provided by the employee so that individuals can submit their tax returns well on time.

An employee can claim LTA for two trips in a block of four years. These block years are different from financial years and are prepared by the Income Tax Department. Currently, we have a block year from January 1, 2014, to December 31, 2017. In this block year, an employee can claim LTA for two trips made during 2014-17, however, if the employee does not make any claim, then the exemption carries over for the next year and not to the next block.
